Deeper Sleeper is developed and operated by Warm Static LLC (“Warm Static,” “we,” “us,” or “our”).

Your sleep information is private. Deeper Sleeper is designed so that your sleep diary and related sleep information remain on your device and are not collected, stored, or transmitted to Warm Static.

This Privacy Policy explains how information is handled when you use Deeper Sleeper.

1. The Short Version

Deeper Sleeper is designed around data minimization and on-device privacy.

• You do not need to create a Warm Static account.
• You do not provide Warm Static with your name or email address to use Deeper Sleeper.
• Your sleep diary is stored locally on your device.
• Your sleep information is processed locally on your device.
• Warm Static does not receive or store your sleep diary.
• Warm Static does not sell your sleep or health information.
• Warm Static does not use your sleep information for advertising or marketing.
• Warm Static does not share your sleep information with advertisers or data brokers.
• Deeper Sleeper does not automatically send your information to a doctor or healthcare provider.
• You decide whether to export or share your sleep information.

Your sleep data belongs to you and stays with you unless you choose to share it.

2. Sleep Information Stored on Your Device

Deeper Sleeper allows you to record and calculate information related to your sleep, which may include:

• Bedtime
• Time you attempt to fall asleep
• Estimated time you fall asleep
• Wake time
• Time out of bed
• Nighttime awakenings
• Time spent awake during the night
• Estimated total sleep time
• Sleep duration
• Sleep efficiency
• Recommended or calculated sleep window
• Sleep quality
• Morning restfulness
• Energy levels
• Sleep-related notes
• Other information you voluntarily enter into your sleep diary

We refer to this information collectively as Sleep Data.

Sleep Data may be considered health information or consumer health data under applicable law.

Sleep Data Stays on Your Device

Deeper Sleeper stores and processes Sleep Data locally on your device.

Warm Static does not receive, collect, transmit, or maintain a server-side copy of your Sleep Data.

Because Warm Static does not possess this information, we generally cannot access, view, retrieve, identify, modify, or remotely delete your Sleep Data.

3. No Personal Identity Is Attached to Your Sleep Data by Warm Static

Deeper Sleeper does not require an account.

Warm Static does not require your:

• Name
• Email address
• Phone number
• Patient identifier
• Medical-record number

in order to create or maintain your Deeper Sleeper diary.

Warm Static does not maintain a database connecting Sleep Data to individual Deeper Sleeper users.

4. Sharing Sleep Information With Your Doctor

Deeper Sleeper may allow you to create, save, export, print, or share a report containing information from your sleep diary.

Any sharing is initiated and controlled by you.

Deeper Sleeper does not automatically transmit your Sleep Data to:

• Doctors
• Therapists
• Sleep specialists
• Hospitals
• Healthcare organizations
• Insurance companies
• Employers
• Warm Static

If you choose to share a Deeper Sleeper report, your device may allow you to send or save that report using applications or services you select, such as email, messaging, printing, file storage, or another application.

Once you intentionally share information outside Deeper Sleeper, the recipient or service you selected may have its own privacy practices.

Warm Static does not control what an independent recipient does with information after you choose to provide it to them.

5. Consumer Health Data

Sleep information can qualify as sensitive health information under certain privacy laws.

To the extent Sleep Data constitutes “Consumer Health Data” under applicable law, Deeper Sleeper processes that information solely on your device in order to provide functionality you request.

Deeper Sleeper may process the sleep-related information listed in Section 2.

The information comes directly from you when you enter information into Deeper Sleeper or from calculations performed locally by Deeper Sleeper based upon information you enter.

Purpose

Deeper Sleeper processes this information locally to provide features including:

• Maintaining your sleep diary
• Calculating sleep duration
• Calculating sleep efficiency
• Establishing or displaying a sleep window
• Showing your sleep history
• Identifying trends
• Providing educational information
• Generating sleep summaries or reports
• Supporting conversations you choose to have with a healthcare provider

Collection by Warm Static

Warm Static does not collect your Sleep Data.

The information is processed locally on your device and is not transmitted to Warm Static.

Sale of Consumer Health Data

Warm Static does not sell Consumer Health Data.

Sharing of Consumer Health Data

Warm Static does not share Consumer Health Data with third parties because Warm Static does not receive or possess your Sleep Data.

Warm Static does not provide Sleep Data to:

• Advertisers
• Advertising networks
• Data brokers
• Marketing companies
• Insurance companies
• Employers
• Social networks

You may independently choose to share information with another person or service using your device.

6. Washington Consumer Health Privacy

Washington's My Health My Data Act provides certain consumers with rights concerning Consumer Health Data held by covered businesses.

Because Deeper Sleeper is designed so that Warm Static does not receive or maintain your Sleep Data, Warm Static generally does not have Sleep Data about you that it can access, provide, or delete.

You control information stored within Deeper Sleeper directly through the application and your device.

If you believe Warm Static possesses personal or health information concerning you, you may contact us at hello@wearewarmstatic.com.

You may request information about whether Warm Static possesses Consumer Health Data relating to you and exercise any applicable rights provided by law.

If Warm Static denies an applicable privacy request, you may appeal by emailing the same address with the subject Privacy Appeal.

7. Analytics, Tracking and Advertising

Deeper Sleeper does not transmit Sleep Data to analytics or advertising services.

Deeper Sleeper does not use Sleep Data for:

• Advertising
• Personalized advertising
• Cross-app tracking
• Marketing
• Data brokerage
• Building advertising profiles
• Determining advertising audiences

Warm Static does not monetize your Sleep Data.

8. Artificial Intelligence and Automated Sleep Guidance

Deeper Sleeper may use software-based calculations or automated logic to provide sleep-related information, recommendations, educational content, or guidance based on information you enter.

These calculations are designed to occur locally on your device.

Your Sleep Data is not sent to Warm Static or to a third-party artificial-intelligence provider in order to generate personalized sleep guidance.

Deeper Sleeper may use calculations based on established sleep concepts, including sleep efficiency and sleep-window calculations.

Any automated recommendation or guidance provided by Deeper Sleeper is informational and educational in nature.

Warm Static does not use your Sleep Data to train artificial-intelligence or machine-learning models.

9. Device Backups and iCloud

Deeper Sleeper stores Sleep Data locally within the application's storage on your device.

Your device operating system may independently include application information within device backups or cloud backup services depending on your Apple settings and how Apple handles application data.

These backup services are operated by Apple, not Warm Static.

Warm Static does not operate an iCloud database containing your Sleep Data and does not access Sleep Data through your iCloud account.

You control Apple's backup and iCloud settings through your Apple device and Apple account.

10. Technical Information

Deeper Sleeper does not intentionally transmit Sleep Data to Warm Static for diagnostics or analytics.

Apple and your device may independently collect operating-system, App Store, crash, or diagnostic information according to Apple's own policies and the privacy settings you select with Apple.

Warm Static does not intentionally include the contents of your sleep diary in diagnostic information.

11. Data Retention and Deletion

Because Sleep Data is stored locally on your device rather than on Warm Static servers, your data remains under your control.

You may delete individual Sleep Data using features provided within Deeper Sleeper where available.

Deleting Deeper Sleeper from your device will generally remove the application's locally stored data from that device, subject to any backups independently maintained by your device or cloud-backup provider.

Warm Static cannot remotely retrieve or delete Sleep Data that it never received.

12. Security

Data minimization is an important part of Deeper Sleeper's security model.

By keeping Sleep Data on your device rather than transmitting it to Warm Static servers, we reduce the amount of sensitive information that Warm Static possesses.

Your device's security protections, including passcodes, Face ID, Touch ID, encryption, operating-system protections, and backup settings, may help protect information stored on your device.

No electronic device or storage method can be guaranteed to be completely secure.

You are responsible for maintaining appropriate security for your device and Apple account.

13. Deeper Sleeper Is Not a Healthcare Provider

Warm Static LLC is not a healthcare provider.

Deeper Sleeper does not establish a doctor-patient, therapist-patient, or other healthcare-provider relationship between you and Warm Static.

Deeper Sleeper is intended as a sleep diary, sleep-tracking tool, and educational companion.

Information, calculations, recommendations, or suggestions provided through Deeper Sleeper are not a diagnosis and are not a substitute for individualized medical advice, diagnosis, or treatment from a qualified healthcare professional.

Users with medical concerns should consult an appropriate healthcare professional.

14. HIPAA

The federal Health Insurance Portability and Accountability Act (“HIPAA”) applies to certain healthcare providers, health plans, healthcare clearinghouses, and their business associates.

Warm Static generally does not become a HIPAA-covered healthcare provider merely because it offers Deeper Sleeper directly to consumers.

Accordingly, you should not assume information stored in a consumer application such as Deeper Sleeper is protected by HIPAA.

Other consumer privacy and health-data laws may provide protections independent of HIPAA.

15. Health Data Breaches

Warm Static does not maintain a central repository of Deeper Sleeper Sleep Data.

If Warm Static ever begins collecting or storing identifiable health information, we will evaluate and comply with applicable privacy, security, and breach-notification requirements.

We will update this Privacy Policy if the way Deeper Sleeper handles Sleep Data materially changes.

16. Third-Party Applications and Services You Choose

You may choose to use your device to export information from Deeper Sleeper to a third-party application or service.

For example, you may choose to:

• Email a report
• Send a report using a messaging application
• Save a report to a file-storage service
• Print a report
• Share a report with a physician
• Save a report somewhere else on your device

These actions occur at your direction.

Those third parties have their own privacy policies and practices, and Warm Static is not responsible for their independent handling of information you choose to provide to them.

17. Children

Deeper Sleeper is not directed to children under the age of 13.

Warm Static does not knowingly collect Sleep Data or other personal information from children under 13 through Deeper Sleeper.

Because Deeper Sleeper does not maintain user accounts or remotely collect Sleep Data, Warm Static generally has no way to identify the age of an individual using the application.

18. Changes to Our Privacy Practices

We may update this Privacy Policy as Deeper Sleeper changes or as privacy laws evolve.

We will update the “Last Updated” date when this Privacy Policy changes.

If Deeper Sleeper changes in a way that causes Warm Static to begin collecting, transmitting, using, selling, or sharing categories of Consumer Health Data that are not described in this policy, we will update our disclosures and obtain consent where required by applicable law before engaging in those practices.

20. Relationship to Warm Static's General Privacy Policy

Warm Static maintains a general privacy policy covering the Warm Static website and other Warm Static products and services.

This Deeper Sleeper Privacy Policy applies specifically to the Deeper Sleeper application and its handling of Sleep Data.

If there is a conflict between this Privacy Policy and Warm Static's general privacy policy concerning Sleep Data processed within Deeper Sleeper, this Deeper Sleeper Privacy Policy controls.
